Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Dana website, messaging assistants, voice experiences, integrations, and related services (collectively, the "Services"), operated by Dana Intelligence, Inc. ("Dana", "we", "us"). By accessing or using the Services, you agree to these Terms.

Eligibility

You must be at least 13 years old to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to accept these Terms on that organization's behalf.

Accounts and security

Using Dana

Connected services

Dana can connect to third-party services, including Google services such as Gmail and Google Calendar, when you authorize those connections. You are responsible for ensuring you have the right to connect each account and direct Dana to access, send, create, update, or otherwise process information from that service.

Your use of third-party services is governed by their own terms and policies. Dana is not responsible for third-party services, but Dana's use of Google user data is described in our Privacy Policy.

User instructions and approvals

You may ask Dana to take actions such as finding calendar availability, creating or updating events, summarizing email, drafting replies, sending emails, or preparing documents. You are responsible for the instructions you give Dana and for confirming that any action taken on your behalf is accurate and appropriate.

Your content

You may submit content to the Services, including messages, voice inputs, prompts, files, feedback, contacts, calendar details, and email-related instructions ("Content"). You retain ownership of your Content. You grant Dana a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display your Content only as necessary to operate, provide, secure, support, and improve the Services and as otherwise described in our Privacy Policy.

Acceptable use

Intellectual property

The Services, including all content and materials provided by Dana except your Content, are owned by Dana or its licensors and are protected by intellectual property laws. Dana grants you a limited, non-exclusive, non-transferable license to use the Services for your personal or internal business purposes, subject to these Terms.

Privacy

Our Privacy Policy explains how we collect, use, store, and share information, including information received from Google APIs and other connected services. By using the Services, you acknowledge the Privacy Policy.

Changes and termination

We may change the Services or these Terms from time to time. We may suspend or terminate your access to the Services if we reasonably believe you violated these Terms, created risk for Dana or other users, or if required by law. You may stop using the Services at any time.

Disclaimers

The Services are provided "as is" and "as available". To the fullest extent permitted by law, Dana disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Dana does not guarantee that outputs will be accurate, complete, or suitable for every use.

Limitation of liability

To the fullest extent permitted by law, Dana will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, goodwill, data, or business opportunities arising from or related to the Services or these Terms.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Dana and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Services, your Content, your connected-service instructions, or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, unless applicable law requires otherwise.
